§ SAM TECHNOLOGY IS AN ONLINE PLATFORM THROUGH WHICH INDIVIDUALS AND/OR LEGAL ENTITIES SEEKING TAX PREPARATION, FILING AND ACCOUNTING-RELATED SERVICES CAN SUBMIT REQUESTS AND CONNECT WITH THIRD-PARTY TAX PROFESSIONALS, WHICH IN TURN PROVIDE THE TAX PREPARATION, FILING AND ACCOUNTING-RELATED SERVICES.
§ THIS PRIVACY POLICY IS A LEGAL AND BINDING AGREEMENT BETWEEN YOU (“YOU,” “YOUR,” “YOURSELF” OR “USER”) AND SAM TECHNOLOGY LLC. THE TERMS “OUR,” “US,” “WE” OR “SAM TECHNOLOGY” IN THIS PRIVACY POLICY REFER TO SAM TECHNOLOGY LLC, A CALIFORNIA LIMITED LIABILITY COMPANY.
§ OUR DIGITAL OPERATIONS ARE CONDUCTED, IN WHOLE OR IN PART, IN THE UNITED STATES, AND ARE SUBJECT TO THE LAWS OF THE STATE OF CALIFORNIA, INCLUDING THOSE GOVERNING PRIVACY AND DATA SECURITY, AND WE WILL PROTECT YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. REGARDLESS OF WHERE YOU LIVE, YOU CONSENT TO HAVE YOUR PERSONAL DATA TRANSFERRED, PROCESSED AND STORED OUTSIDE OF THE COUNTRY WHERE YOU ARE LOCATED, INCLUDING IN THE UNITED STATES, AND ALLOW SAM TECHNOLOGY TO USE AND COLLECT YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE PRIVACY POLICY. SAM TECHNOLOGY REGULARLY UPDATES OUR APPS AND WEBSITES TO MAKE IMPROVEMENTS, INCLUDING IMPROVEMENTS THAT BETTER SERVE YOUR PRIVACY RIGHTS. TO ENSURE THAT THIS PRIVACY POLICY ACCURATELY REFLECTS YOUR USE OF OUR SERVICES YOU WILL NEED TO ENSURE THAT YOU ARE USING THE MOST RECENT RELEASE OF OUR APPS AND WEBSITES. 1. COLLECTION OF INFORMATION
Depending on how you interact with us, SAM TECHNOLOGY processes different kinds of information and in different ways. Some information is automatically processed if you visit our Websites or use our Services. Other information is only processed if you actively submit it to us (like using our web forms to get in touch with us or uploading content to our Websites).
1.1 PERSONAL INFORMATION WE MAY COLLECT
A. In order for you to use the Services, SAM TECHNOLOGY may require you to provide us with information that identifies you as an individual (“Personal Information”).
B. SAM TECHNOLOGY may collect Personal Information from you that includes, but is not limited to: (1) your name and your contact data (such as your email address, phone number, billing and physical addresses, and your application login and password); (2) demographic data (such as your gender, your date of birth and your zip code); (3) profile and account information, which includes your social media information and other information; (4) location information of your device that you use with the Apps, provided that your device settings allow us to collect such location information; (5) sensitive personal information (such as racial or ethnic origin; biometrics; union membership; state ID; contents of messages when we are not the recipient); (6) biometric information (such as image, keystrokes, behavioral or biological characteristics); (7) payment information (such as credit card numbers, financial account information, and other payment details); and, (8) device and browsing information, including information about your phone, tablet or other device, and online browsing activity. This may also include IP addresses, unique device identifiers, cookie identifiers, device and browser settings and information, and wireless service provider information. We may also collect information about how and when you access the Apps, including the date, time and duration of each visit to the Apps and what actions you take on the Apps.
C. If you communicate with us by, for example, email or letter, any information provided in such communication may be collected as Personal Information.
1.2 HOW WE MAY COLLECT PERSONAL INFORMATION
A. You may choose to provide us with Personal Information to receive certain services. You agree to let us use and share the Personal Information you submit for the purposes described in this Privacy Policy, or otherwise agreed to by you, including providing and customizing services, conducting our business (including for internal business operations, analytics, and to provide, develop, change, market or optimize our Services and products), and to communicate and market to you directly or via third parties.
B. You provide your Personal Information: (1) when you register for an account, make a purchase, contact us, interact with customer service, chat using the Websites’ communications functions, respond to a survey or otherwise; (2) automatically from mobile devices, such as information about the location of your mobile device; (3) through third-parties, such as service providers that SAM TECHNOLOGY uses, analytics companies, advertising networks, demographic companies, and other third parties that SAM TECHNOLOGY works with; (4) SAM TECHNOLOGY may use Google Analytics to collect and review user data; (5) SAM TECHNOLOGY uses cookies and third-party websites or apps such as Google Analytics, which also implement cookies to collect information about users’ activity on the Services; and, (6) SAM TECHNOLOGY may include links to third-party websites or apps that are not affiliated with SAM TECHNOLOGY, or such third-party services may link to the Services.
C. SAM TECHNOLOGY uses and discloses this information only in accordance with your express authorization, which we request from you through a separate document when you sign up to use the Services.
D. When a user signs up to use the Services, SAM TECHNOLOGY allows the user to generate and submit content, including but not limited to videos, images, text, or other materials ("User-Generated Content") on the platform. All users acknowledge and agree that any User-Generated Content submitted, uploaded, or otherwise provided to the Websites may be used by SAM TECHNOLOGY in accordance with the Terms of Service.
All users also grant us a license to use, reproduce, distribute, prepare derivative works of, display, and perform the User-Generated Content in connection with the Websites and SAM TECHNOLOGY’s business operations. Such content may be used for promotional purposes, redistributed on the Websites and elsewhere, and shared on social media. SAM TECHNOLOGY reserves the right to review and moderate User-Generated content to ensure compliance with the Websites’ guidelines and policies.
E. When you use the Services, we may collect certain information about you and your device automatically through the use of cookies, web beacons, and similar technologies. A “cookie” is a small data file sent from a website and stored on your device to identify your device in the future and allows for an enhanced personalized user experience. A “session cookie” disappears after you close your web browser, or may expire after a fixed period of time. A “persistent cookie” remains after you close your web browser and may be accessed every time you use our Services. SAM TECHNOLOGY may use both session and persistent cookies. You should consult your web browser to modify your cookie settings. We may also use Local Shared Objects (sometimes referred to as “Flash Cookies”), which are similar to standard cookies except that they can be larger and are downloaded to a computer or mobile device by the Adobe Flash media player. By using the Services, you consent to our use of cookies and similar technologies.
F. SAM TECHNOLOGY may also receive information about you from other sources, including through third-party services and organizations. SAM TECHNOLOGY may combine our first-party data, such as your email address or name, with third-party data from other sources and use this to contact you (e.g. through direct mail). For example, if you access third-party services, such as Facebook, Google, or Twitter to login to the Services or to share information about your experience on the Services with others, SAM TECHNOLOGY may collect information from these third-party services.
1.3 NON-PERSONAL INFORMATION WE MAY COLLECT
A. “Non-Personal Information” is any information that does not reveal your specific identity. SAM TECHNOLOGY may collect Non-Personal Information in a variety of ways, including:
1) Through your device: Certain information is collected automatically through your device, such as your operating system name and version, device manufacturer and model, device identifier, language, the name and version of the software application you are using. SAM TECHNOLOGY uses this information to ensure that the Services function properly and to understand usage of the Services. If you give us your consent, SAM TECHNOLOGY may collect information about the physical location of your device, for example, using your device’s GPS functionality. SAM TECHNOLOGY may use such information to provide you with personalized location-based services and content. SAM TECHNOLOGY may also share your device’s physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with more personalized content and to study the effectiveness of advertising campaigns. You will be permitted to allow or deny such uses and/or sharing of your device’s location, but if you choose to deny such uses and/or sharing, SAM TECHNOLOGY and/or our marketing partners may not be able to provide you with the applicable personalized services and content
2) Through other devices: Certain information may also be collected automatically through devices that are linked or paired to the Services.
3) Through server log files: Your “IP Address” is a number that is automatically assigned to the device that you are using by your Internet Service Provider (ISP). An IP Address is identified and logged automatically in our server log files whenever a user uses the Services, along with the time of the use and the pages visited within the Apps. SAM TECHNOLOGY uses IP Addresses for purposes such as helping to calculate Websites usage levels, diagnose server problems and administer the Services.
4) From you: SAM TECHNOLOGY may collect Non-Personal Information such as your general geographic location, as well as other information, such as your preferred means of communication, when you voluntarily provide such information to us. Unless combined with Personal Information, this information does not personally identify you or any other user of the Services.
5) By de-identifying information: “Aggregated Personal Information” is information that is derived from Personal Information that does not personally identify you or any other user of the Services. For example, SAM TECHNOLOGY may aggregate Personal Information to calculate the percentage of our users who have a particular telephone area code or a zip code.
2. USE AND DISCLOSURE OF INFORMATION
2.1 HOW WE MAY USE PERSONAL INFORMATION. SAM TECHNOLOGY and our third-party service providers may use Personal Information:
A. To provide products and services in connection with fulfilling orders, processing payments, maintaining user profiles, and suggesting products we think you might be interested in;
B. To respond to you when you contact customer service, request information or assistance, complete a survey, share comments on the Services, and enter and/or win sweepstakes and giveaways;
C. For analytics, to understand how you use the Services and to improve, customize, and market our Services and content, and for other business purposes;
D. For lawful business purposes, such as to operate and improve upon our business, to maintain our accounts and records, to communicate with you in order to determine your satisfaction with the Services, to detect and prevent fraud and misuse of the Services, and for any other business purpose that are permitted by law;
E. To provide you with customized content, targeted offers, promotions and advertising on the Services, through other third-party sites or apps, or via email, text messages, or push notifications offered by SAM TECHNOLOGY or our partners that might be of interest to you, including sending you information and newsletters from SAM TECHNOLOGY or one of our partners and sending you occasional customer surveys for the purpose of improving our product and service offerings to you;
F. To protect the security or integrity of the Services and our business, including by protecting against and preventing fraud, unauthorized transactions, claims and other liabilities, and managing risk exposure;
G. To further our business purposes, such as quality assessment, data analysis, audits, developing new products, improving the Services, identifying usage trends to inform members of our community which might be useful to them, and determining the effectiveness of our promotional campaigns; and
H. To act as we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public or government authorities; (iv) to enforce our Terms of Service; (v) to protect our operations or those of any of our affiliates; (vi) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (vii) at our discretion under emergency circumstances, to notify appropriate authorities; or (viii) to allow us to pursue available remedies or limit the damages that we may sustain.
2.2 HOW WE MAY DISCLOSE PERSONAL INFORMATION. Your Personal Information may be disclosed to:
A. Our third-party service providers that provide services such as hosting of the application, data analysis, IT services and infrastructure, customer service, mail delivery, auditing and other similar services;
B. Providers that help facilitate or fulfill user orders, sponsorship deals, or other transactions;
C. Our affiliates, for the purposes described for Personal Information in this Privacy Policy, including marketing purposes relating to their products and services;
D. Third parties, to permit them to send marketing communications to you regarding the Services;
E. A third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding); and
F. A third party as we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public or government authorities; (iv) to enforce our Terms of Service; (v) to protect our operations or those of any of our affiliates; (vi) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (vii) at our discretion under emergency circumstances, to notify appropriate authorities; or (viii) to allow us to pursue available remedies or limit the damages that we may sustain.
2.3 HOW WE MAY USE AND DISCLOSE NON-PERSONAL INFORMATION. Because Non-Personal Information does not personally identify you, SAM TECHNOLOGY may use and disclose Non-Personal Information for any purpose. SAM TECHNOLOGY may share, disclose or sell non-identifiable aggregate or anonymous information with our affiliates, agents, service providers, business partners, or any other third parties for their marketing or analytics uses or for other lawful purposes. This type of non-identifiable and aggregate information cannot be used to identify you personally. If SAM TECHNOLOGY combine any Non-Personal Information with Personal Information, the combined information will be treated by us as Personal Information as long as it is so combined.
3. SHARING PERSONAL INFORMATION WITH THIRD PARTIES
SAM TECHNOLOGY treats your Personal Information with care and confidentially and will only pass it on to third parties to the extent described below and not beyond. SAM TECHNOLOGY does not share, sell, rent, or trade Personal Information with third parties for any promotional purposes. Where our affiliates, resellers, or service providers process Personal Information, they will do so solely on our instructions and have undertaken to comply with strict contractual requirements for the security of your data (including, but not limited to, complying with this Privacy Policy).
A. Internal: Personal information is shared for our legitimate business purposes, such as managing our relationship with you and other external parties, compliance programs, or systems and networks security. SAM TECHNOLOGY does this to improve efficiency, for cost savings, and internal collaboration between our subsidiaries. Our internal access to personal information is restricted and granted only on a need-to-know basis. Sharing of this information is subject to the appropriate our intra-company arrangements, our policies, and security standards.
B. Service Providers, Contractors, and Agents: SAM TECHNOLOGY shares your data with third-party companies who perform services on our behalf, like payment processing, fraud and abuse prevention, data analysis, marketing and advertising services (including retargeted advertising), email and hosting services, and customer services and support. These service providers may access your personal data (all data categories) and are required to use it solely as we direct, to provide our requested Services. Specifically, SAM TECHNOLOGY may provide paid products and/or services within the Services. In that case, SAM TECHNOLOGY may use third-party services for payment processing (e.g., payment processors). SAM TECHNOLOGY will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their privacy policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.
C. Business Transactions: In the event we go through a business transaction such as a merger, an acquisition by another company, or a sale of all or a portion of our assets to which this Privacy Policy relates, your Personal Information will likely be among the intangible assets transferred and, in such case, you will be notified in advance via e-mail and/or a prominent notice on our Websites of such change in ownership or a change in the use of your Personal Information, as well as any choices you may have regarding your Personal Information (including, if applicable, your right to object to such transfer).
D. Public Authorities: Although we make every effort to preserve user privacy, we may need to disclose Personal Information when required by law, such as when we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order, or litigation or other legal process or action (whether or not initiated by us) to protect our, our users’ or third parties’ rights, property or safety. SAM TECHNOLOGY will transmit data to public authorities such as law enforcement or tax authorities only in the case of a legal obligation to do so based on a request for information from the respective authority.
E. Promotional Offers: As a registered user, you may receive news and special offers from us regarding the Services or the services of third parties who we think may offer services that would be of interest to you.
F. With Your Permission: With your consent, SAM TECHNOLOGY may share data (all data categories) with third parties outside the scope of this Privacy Policy.
4. TIMEFRAME FOR KEEPING INFORMATION
A. SAM TECHNOLOGY processes and stores your Personal Information as long as necessary for the fulfillment of our contractual or legal obligations. Thus, we store the data as long as our contractual relationship with you as our customer obliges us to do so.
B. After termination of our contract, we will store Personal Information only to the extent and for as long as applicable law requires. All other data will be deleted immediately when you, as a customer, unsubscribe from our Services. If the remaining information is no longer required for the fulfillment of legal obligations, it will be regularly deleted, unless further processing is necessary for the preservation of evidence or the prevention of legal claims from becoming time-barred.
5. REVIEWING AND REQUESTING CHANGES TO YOUR INFORMATION
A. You may update, delete, access, or change your account information by editing your data. While you cannot access or change the nonpersonal information that we collect, you can review your personal profile on the Apps or Websites and correct or update it by sending a request to privacy@mysamadmin.com. You can opt out of marketing or advertising emails by utilizing the “unsubscribe” link or mechanism noted in advertising or marketing emails you receive from us. You can opt out of push notifications by selecting the appropriate setting directly on your mobile device.

6. INFORMATION FOR EU RESIDENTS
A. You are not legally required to provide us with the Personal Information described in this Privacy Policy. Further, the contractual relationship that you might have entered into with us by using the Services does not imply any obligation to provide your Personal Information. However, you might not be able to use the Services to the full extent, or in some cases you may not be able to use the Services at all, if you do not provide us with certain data or object to the use of this data.
B. Our Legal Basis for Processing: When processing your Personal Information, SAM TECHNOLOGY relies on the General Data Protection Regulation (“GDPR”), an EU-wide legal framework for the standardization of data protection. SAM TECHNOLOGY primarily processes data as a controller, for the purposes explained above under Sections 1 and 2 of this Privacy Policy. These purposes represent our legitimate interests for the purposes of Article 6(1)(f) GDPR. At the same time, some of the Personal Information we process is necessary for us to perform a contract with you or in order to take steps at your request prior to entering into a contract with you. For example, if you express your interest in using one of the Services, such as by filling out a webform, we will process the Personal Information submitted to comply with your request. This may include sharing your Personal Information with one of our authorized resellers, who will then use your Personal Information to complete the purchase transaction. In addition, SAM TECHNOLOGY is legally obliged to provide certain information to criminal prosecution or tax authorities in individual cases upon request. In these cases, the legal basis for the processing is either legal requirements (Article 6(1)(c) GDPR) or reasons of public interest (Article 6(1)(e) GDPR). Where we process your Personal Information with your explicit consent, pursuant to Article 6(1)(a) GDPR, this declaration of consent will be the legal basis for processing your Personal Information.
C. Transferring your Data outside the EU or the EEA: Our principal place of business is in the State of California, where the United States is a “Third Country” under the GDPR. Third Countries are generally not considered to afford the same level of protection that you enjoy in the EU, but we still provide an adequate level of protection for your Personal Information. SAM TECHNOLOGY has ensured that our service providers and affiliates have been subjected to strict contractual provisions in their contracts with us to guarantee that an adequate level of data protection for your data is guaranteed.
D. User Profiles: SAM TECHNOLOGY uses your data for “Profiling.” This means that we use your data to make tailored offers based on your previous behavior as well as to serve you personalized ads. However, SAM TECHNOLOGY will never process and analyze your Personal Information in the context of Profiling in a way that would lead to an automated decision that has a legal effect on you or significantly impairs you in a similar way.
E. Your rights regarding the processing of your Personal Data: As a natural person, you have certain rights as “Data Subject.” You can assert the following rights against us under the GDPR:
1) Your right to information and access under Article 15 GDPR;
2) Your right to rectification under Article 16 GDPR;
3) Your right to erasure under Article 17 GDPR;
4) Your right to restriction of processing under Article 18 GDPR; and
5) Your right to data portability under Article 20 GDPR.
In addition, you have a right of objection to the competent data protection supervisory authority under Article 77 of GDPR, but only with respect to the data processing we conduct on our own behalf, as a controller. In the event we act as a processor of your data for a third party, you must refer to the entity acting as controller to assert this right. F. Information about your Right of Objection under Article 21 of GDPR.
1) Right of objection in individual cases
In addition to the rights aforementioned, you have the right, for reasons arising from your particular situation, to object at any time to the processing of Personal Information relating to you, which is processed on the basis of Article 6(1)(e) of GDPR (data processing in the public interest) and Article 6(1)(f) of GDPR (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Article 4(4) of GDPR. If you file an objection, we will no longer process your Personal Information unless we can prove compelling grounds for the processing that outweigh your interests, rights and freedoms or the processing serves to assert, exercise, or defend legal claims. If we terminate the processing due to your objection, the Services may no longer be available to you or only available in a limited capacity.
2) The right to object to the processing of data for advertising purposes
You also have the right to object at any time to the processing of your Personal Information for the purpose of direct marketing, including any subscription to our newsletters or personalized ads; this also applies to Profiling, insofar as it is associated with such direct marketing. F. No Profiling

I. Right to Disclosure of Marketing Information
California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California residents to request certain disclosures regarding Personal Information shared with affiliates and/or third parties for marketing purposes. Consumers who are residents of California may request (i) a list of the categories of personal information disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes; and (ii) a list of the categories of third parties to whom we disclosed such information.

8. COLLECTING INFORMATION FROM CHILDREN
We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act), we do not collect any information from anyone under 13 years of age. Our Services are not intended for children under the age of 13. SAM TECHNOLOGY does not direct the Services to, nor do we knowingly solicit or collect information from anyone who tells us that he or she is under 13 years of age. If SAM TECHNOLOGY learns that a child under the age of 13 has provided Personal Information to the Services, we will use reasonable efforts to remove such information from our files. Parents should be aware that there are parental control tools available online that they can use to prevent your children from submitting Personal Information online without parental permission or from accessing material that is harmful to minors.
